OPS as Your Public Defender

The Public Solicitor provides legal representation to almost all accused persons charged with an indictable offence in Papua New Guinea. Indictable offences are serious criminal cases that come before the Grade Five Courts, the National Courts, and by way of appeal or review to the Supreme Court of Justice.

The Public Solicitor plays a pivotal role in removing the perception that there are two sets of laws — one for the common people and another for the rich and powerful. All persons are protected equally under the law.

Important Notice

Legal Aid Fees — Know the Rules

Neither the lawyers nor the staff in the employ of the Public Solicitor's Office have any authority to charge or receive any fees directly from persons seeking legal assistance.

Any charges sanctioned by the Public Solicitor will be properly rendered by way of a Memorandum of Fee and paid into the Public Solicitor's Legal Aid Trust Account — in accordance with the Public Solicitor (Charges) Act 1976.

If anyone demands direct payment, report it immediately.

Eligibility

Who Qualifies for Legal Aid?

Legal aid is provided to impecunious persons — those who cannot afford private legal counsel. All applications must be lodged with relevant documents and information.

Walk into any of our 8 offices nationwide. A duty lawyer will speak with you at no cost.

Bring Your Documents

Bring all relevant documents and case information to support your legal aid application.

Lodge Application

Complete and submit a Legal Aid Application form. The Public Solicitor reviews and decides.

Receive Decision

If approved, a lawyer is assigned to your case. If refused, you may apply to the National Court for review.
